Charges laid after Victorian slip
WorkSafe Victoria is laying charges against three businesses over their response to a landslip that left a giant hole in Mt Waverly.
A corner property at Highbury Rd collapsed after heavy rain in mid-2015, leaving a hole that required over 16,000 cubic metres of dirt to fill.
Two neighbouring townhouses were left teetering on a 15m drop, and are still barricaded with temporary fencing, the tenants having moved to alternative housing.
Action Master Builders Pty Ltd has been charged with breaching section 26(1) of the Occupational Health and Safety Act by failing to ensure the workplace was safe and without risks to health.
Company director Dimitrios Nicolaou was charged with a count of breaching section 144 - failing to ensure the workplace was safe and without risks to health.
AM Design & Construction Pty Ltd was charged with one count of breaching section 23(1) which relates to failure to ensure persons other than employees were not exposed to risks to health and safety.
Company director Aldo DiTonto also faces a charge of breaching section 144.
Ranjan Fernando Consulting Engineers Pty Ltd was charged with one count of breaching section 23(1) as well, while its director Thewarathanthrige Ranjan Fernando was also charged with one count of breaching section 144.
