Court set for NT crush
NT WorkSafe has initiated legal proceedings against Darwin-based Topline Steel Fabrications (NT) Pty Ltd and two senior officers following a workplace incident in September 2023 that left a contractor with severe injuries.
The case highlights alleged failings in workplace safety practices and the enforcement of accountability under health and safety laws.
The incident occurred at Topline’s Yarrawonga facility when a contractor from a transport company was collecting a steel delivery.
During the operation, a forklift operated by the company’s Operations Manager dropped a steel bundle weighing over 1.2 tonnes. The contractor, who was acting as a spotter, sustained serious injuries when the load fell from the forklift tynes.
NT WorkSafe alleges the company lacked adequate safety protocols for forklift operations and had ineffective safety management systems in place. It is also alleged that the Operations Manager was operating the forklift without a valid licence, which had expired in 2015.
Topline Steel Fabrications has been charged with failing to ensure the contractor's safety and maintaining a safe work environment.
The company's Director and Operations Manager face multiple charges, including breaching their duty of care and failing to exercise due diligence.
Additionally, Mr Blyth is accused of operating the forklift without the required licence under workplace safety regulations.
If convicted on all charges, the potential penalties include a maximum fine of $2 million for the company, $700,000 for the Director, and $720,000 for the Operations Manager.
The case is scheduled for mention at the Darwin Local Court on 9 December 2024.
